Terms and Conditions
§ 1 Scope of Application - Subject Matter of the Contract
Our terms and conditions apply to the delivery of movable goods in accordance with the contract concluded between us and the customer.
§ 2 Offer - Conclusion of Contract - Offer Documents
1) The customer's order constitutes a binding offer that we can accept within one week by sending an order confirmation or by delivering the goods. Offers previously submitted by us are subject to change. If it is a consignment transaction, this will be pointed out separately. The contract products that the seller receives as a sales agent from its respective contractual partner remain the property of the respective contractual partner of the seller until they are transferred to the buyer. The sales agent will sell the items in question in his own name on behalf of the contractual partner.
2) If the customer orders the goods electronically, the contract text and these terms and conditions will be saved in a reproducible form and sent to the customer by e-mail upon request.
§ 3 Validity and Compliance with the Legal Provisions of §§ 86, 86a StGB (German Criminal Code)
1) Sammlerparadies24® assures that the contemporary historical and military historical objects from the period 1933-1945 offered in the online shop are only offered for the purposes of civic education, the defense against anti-constitutional and anti-constitutional efforts, scientific and art-historical research, the enlightenment or reporting on the events of contemporary history or military-historical and uniform-related research (§ 86 a StGB). By placing orders for items that are marked with emblems of the Third Reich, the purchaser undertakes to acquire these items only for historical-scientific purposes for the aforementioned reasons and not to use them in any way for propaganda purposes, in particular not in the sense of § 86a StGB.
2) Edged, pointed and thrusting weapons are only sold to persons who have reached the age of 18.
§ 4 Prices and Terms of Payment
1) The offered purchase price is binding. This includes the statutory sales tax. Those products that are subject to differential taxation are specifically identified in the product description.
2) The purchase price can only be paid by advance payment, cash payment on site, PayPal or Amazon Payments.
The buyer undertakes to pay the purchase price after conclusion of the purchase contract within a period of four working days, starting from the conclusion of the purchase contract. After full payment of the purchase price, the seller undertakes to send the goods to the buyer by post or forwarding agency without delay, but no later than within 5 working days after full payment of the purchase price, unless self-collection has been agreed. Partial deliveries are permissible insofar as they are reasonable for the buyer.
If the seller does not receive the agreed purchase price four days after conclusion of the contract, he can withdraw from the contract after setting a renewed unsuccessful deadline for payment.
If collection of the goods has been agreed, the buyer is obliged to collect the goods from the seller within seven days of payment of the purchase price. If the buyer does not collect the goods within this period, the buyer is in default. The seller can then claim damages in the amount of €5 per day for an additionally incurred warehouse rental.
3) Price changes are permitted if more than four months lie between the conclusion of the contract and the separately agreed delivery date. If the wages or material costs change after this point until delivery, we are entitled to change the price appropriately in accordance with the cost increases or cost reductions. The customer is only entitled to withdraw if a price increase exceeds the increase in the general cost of living between order and delivery not only insignificantly.
4) The customer is only entitled to offsetting rights if his counterclaims have been legally established, are undisputed or have been recognized by us. In addition, he is authorized to exercise a right of retention insofar as his counterclaim is based on the same contractual relationship.
§ 5 Delivery Time
If delivery periods are specified by us and have been made the basis for the order, such periods shall be extended in the event of strikes and cases of force majeure, namely for the duration of the delay. The same applies if the customer does not fulfill any obligations to cooperate.

Cancellation Policy
Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day,
- on which you or a third party named by you, who is not the carrier, have taken possession of the goods or has taken possession of the goods, provided that you have ordered one or more goods as part of a single order and this is delivered or will be delivered uniformly;
- on which you or a third party named by you, who is not the carrier, have taken possession of the last good or has taken possession of the last good, provided that you have ordered several goods as part of a single order and these are delivered separately;

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments we have received from you, including delivery charges (with the exception of additional costs arising from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your withdrawal from this contract. For such reimbursement, we will use the same means of payment that you used in the original transaction, unless you have expressly agreed otherwise; in no case will you be charged any fees for such reimbursement. We may refuse reimbursement until we have received the goods back or until you have provided evidence that you have sent back the goods, whichever is the earlier.
You must return or hand over the goods to us without undue delay and in any event not later than fourteen days from the day on which you notify us of withdrawal from this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.
You shall bear the direct costs of returning the goods that can be sent by post. You shall also bear the direct costs of returning the goods which, due to their nature, cannot be sent by post. The costs for these goods are estimated at a maximum of approximately EUR 150.
You shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

§ 7 Liability for Defects
1) We shall be liable for defects in accordance with the statutory provisions, unless restrictions arise from the following. The customer must notify us of obvious defects in writing within two weeks of the occurrence of the defect. If the notification is not made within the aforementioned period, the warranty rights shall expire. This does not apply if we have fraudulently concealed the defect or have assumed a guarantee for the quality of the item.
2) The limitation period for claims for defects in the delivery of new goods is two years, calculated from the transfer of risk. For used goods, the warranty period is uniformly one year, calculated from the transfer of risk. This does not apply insofar as claims for damages due to defects are concerned. § 7 applies to claims for damages due to a defect.
3) The customer does not receive guarantees in the legal sense from us.
§ 8 Liability for Damages
1) Our liability for contractual breaches of duty and tort is limited to intent and gross negligence. This does not apply to injury to life, body and health of the customer, claims due to the violation of cardinal obligations, i.e. obligations that arise from the nature of the contract and whose violation endangers the achievement of the purpose of the contract, as well as the compensation of damages caused by delay (§ 286 BGB). In this respect, we are liable for any degree of fault.
2) The aforementioned exclusion of liability also applies to slightly negligent breaches of duty by our vicarious agents.
3) Insofar as liability for damages that are not based on the injury to life, body or health of the customer is not excluded for slight negligence, such claims shall become statute-barred within one year, beginning with the occurrence of the claim.
4) Insofar as the liability for damages is excluded or limited to us, this also applies with regard to the personal liability for damages of our employees, workers, staff, representatives and vicarious agents.
§ 9 Retention of Title
1) We reserve title to the object of purchase until full payment of the purchase price.
2) The customer must inform us immediately of enforcement measures by third parties against the goods subject to retention of title, handing over the documents necessary for an intervention; this also applies to impairments of any other kind. Regardless of this, the customer must point out the rights existing in the goods to the third parties in advance.
§ 10 Limitation Period Own Claims
Our claims for payment shall become statute-barred in five years, deviating from § 195 BGB. With regard to the beginning of the limitation period, § 199 BGB applies.
§ 11 Form of Declarations
Legally relevant declarations and notifications that the customer has to submit to us or a third party must be made in writing.
§ 12 Place of Performance - Choice of Law - Place of Jurisdiction
1) Unless otherwise stipulated in the contract, the place of performance and payment is our place of business. The statutory provisions on places of jurisdiction shall remain unaffected unless otherwise stipulated in the special provision of paragraph 3.
2) The law of the Federal Republic of Germany shall apply to this contract. This does not apply if special consumer protection regulations in the customer's home country are more favorable.
3) If the customer does not have a general place of jurisdiction in Germany or in another EU member state, the exclusive place of jurisdiction for all disputes arising from this contract is our place of business.

Lighting/Electrics: In vintage lamps, the electrics are in their original condition. We strongly recommend having them checked by a professional before use. Use is at your own risk.
Decoration: Unless otherwise stated in the product description, these are decorative or collectibles that are not suitable as children's toys.
17.2 Manufacturer information: If a brand name (e.g. Villeroy & Boch, Dyrlund, UnoAerre) is mentioned in the product description, this refers to the original manufacturer of the vintage object. Please note that many historical manufacturers no longer exist or do not maintain a product safety history for objects from this era.
